BAMISE: COURT ADJOURNS ANDREW NICE'S TRIAL OVER ABSENCE OF SUBMISSION OF FINAL WRITTEN ADDRESS
Justice Sherifat Sonaike of Lagos State High Court sitting in Tafawa Balewa Square (TBS), yesterday adjourned the matter due to absence of submission of final written address from defence counsel.
The ongoing trial of Bus Rapid Transport (BRT) driver, Andrew Nice Ominikoron, who is alleged to have killed 22-year-old fashion designer, Oluwabamise Ayanwola, was fixed yesterday for the adoption of the final written address, after the defendant’s counsel, Mr. Abayomi Omotubora, was absent on the grounds of ill health, at the last sitting on November 29, 2024.
In the abscence of the defence counsel again, the Prosecution Counsel, M.F. Salau, noted that the matter was for adoption of written addresses but they were yet to be served. She added that it had been long overdue and couldn't ascertain why defence counsel was yet to serve the address and asked for further date.
Justice Sonaike in response asked the prosecution counsel to go ahead and make an application to file their written address.
She said, "This matter was adjourned on November 29, 2024, that is two months ago and the defence counsel is yet to file his written address."
She however said that having listened to the prosecution counsel who noted that there had been no letter or inforation from Omotubora given as a reason or his abscence or why the final written address has not been filed, the case is adjourned to February 10, 2025 for adoption of final written address.
